General Terms and Conditions for Passengers
These General Terms and Conditions set out the terms and conditions of use of the LimeJet application, which connects passengers with carriers and their drivers to help them navigate cities more efficiently.
The term "us" or "we" refers to the owner of the LimeJet application, the company QVOTA sr o, a limited liability company, VAT ID: SK2023651465, ID: 46910590, registered office: ul. Svornosti 50 821 06 Bratislava - Podunajské Biskupice district (hereinafter also referred to as "LimeJet").
1. Using LimeJet
1.1 LimeJet provides transport services through taxi operators, taxi drivers and taxis, which are registered in the carrier's concession through the use of the LimeJet Platform. LimeJet does not provide transport services. Transport services are provided by carriers through drivers on the basis of a contract (concluded by them as passengers) on the carriage of passengers. Carriers provide transport services independently of taxi operators. Disputes arising from consumer rights, legal obligations or legislation applicable to the provision of transport services will be resolved between the passengers and the carriers.
1.2 If you use the LimeJet application, you can only pay using the LimeJet application.
1.3 While using the LimeJet application, the passenger's mobile number is linked to the relevant LimeJet user account and added to our database. If you no longer use your mobile number, you must notify LimeJet within 7 days so that we can anonymize your account information. If you don't notify us of the change in your number, your mobile carrier may assign your number to another person. If you continue to use LimeJet, this other person may see your personal information.
2. Promotional codes
2.1. LimeJet can send you promotional codes. The promotional code credit may be used to pay after the ride or for other features or benefits related to the LimeJet and / or third party service. Promotional codes are subject to additional terms and conditions that are set specifically for promotional codes. Promotion code expiration dates will appear in the app when the promotional code is activated.
2.2. If the amount of the fare exceeds the applicable credit allocated to your ride, the balance will be automatically deducted from your account. The credit within the promotional code only applies to the given ride and cannot be passed on to the next ride and is automatically forfeited. Only one promotional code can be used per ride.
2.3 LimeJet reserves the right to cancel any promotional code at any time for any reason. This includes a situation where LimeJet determines that codes are being used illegally or fraudulently, or have been issued incorrectly, or have expired.
3. Payment within the LimeJet application
3.1 You can pay for transport services using the LimeJet application. Providing payment options within the LimeJet application acts as a sales representative for transport service providers. Your obligation to the transport service provider is fulfilled after entering a payment order for the transfer of funds to the LimeJet bank account. You, as the passenger, are responsible for ensuring that payment is made and that you have sufficient funds.
3.2 For payments via the LimeJet application, the travel payment is transferred to the carrier. LimeJet may request additional information from you to verify your payment method.
3.3 However, when paying for transport services via the LimeJet application, LimeJet is not responsible for any costs associated with making the payment (mobile operator costs, bank charges, etc.). These service providers may charge you additional fees when processing payments in connection with a payment in LimeJet. LimeJet is not responsible for any such fees and disclaims any responsibility in this regard. The method of payment may also be subject to additional conditions imposed by the relevant third party payment service provider. Please review these terms and conditions before using your chosen form of payment.
3.4 LimeJet is responsible for the operation of payments within the LimeJet application and also provides troubleshooting support. Payments related to payments within the LimeJet application are resolved directly through us. For payment support service, contact: email@example.com. We respond to requests sent by e-mail or via the LimeJet application within one working day. LimeJet will resolve complaints and requests related to the payment of the application within two working days.
** 4. Ordering and cancellation of transport services **
4.1 If you order a transport service and the carrier or driver has agreed to the journey, the transport service shall be deemed to have been ordered.
4.2 When the carrier resp. the driver confirms that he will make your ride, you will conclude with the carrier or. with the driver a separate contract for the transport of persons under the conditions under which the carrier or. the driver agrees. LimeJet does not drive and is not a party to your agreement with the relevant carrier or guide.
4.3 Cancellation of the ordered transport service is considered to be a situation where dopravcaresp. the driver has responded to your request and you will subsequently refuse or cancel the service. If the request for transport service is canceled after a certain time, the driver is entitled to pay the cancellation fee specified in the LimeJet application.
4.4 If you cancel your request for a service several times in a row within 24 hours, we may temporarily suspend your account as a warning. After several such notifications, we may suspend your account for an extended period (e.g. 6 months). After this period, you can request a reactivation of your account, and your request will be reviewed by us.
4.5 When the carrier resp. the driver notifies the passenger of the arrival of the vehicle at the destination and the passenger who ordered the ride or the passengers for whom the ride was ordered does not arrive at the vehicle within the time period specified in the LimeJet application, the travel request is considered canceled. Sometimes the driver may decide to cancel your request. In this case, please note that LimeJet is not responsible for such situations.
4.6 How suddenly the carrier resp. the driver arrives at the destination and sends you a notification that he has arrived at the destination, the LimeJet application can start charging fees for the so-called stand according to the rates stated in the LimeJet application.
4.7 If you have requested transport services using the LimeJet application and have caused damage to the carrier's vehicle or its equipment (inter alia by damaging or contaminating the vehicle or causing odors in the vehicle), the carrier resp. the driver has the right to demand that you pay a fine of EUR 50 and to claim damages in excess of the amount of the fine. If you do not pay the fine and / or damages, LimeJet may pursue claims on behalf of the transport service provider.
5. License to Use LimeJet
5.1 If you comply with the Dispatch Operator's Conditions of Carriage, these General Terms and Conditions for Passengers, we agree to grant you a free, revocable, non-exclusive right to access and use the LimeJet application in accordance with the Dispatch Operator's Conditions of Carriage and these General Terms and Conditions for Passengers, Notice of Privacy and Terms of Application Trading. You may not transfer or sublicense this right to use LimeJet. If you revoke your right to use the LimeJet application, the relevant non-exclusive license will also be revoked.
6.1 As the LimeJet application mediates transport services through taxi operators, taxi drivers and taxis registered in the carrier's concession through the use of the LimeJet Platform between passengers and carriers, we cannot guarantee or be responsible for the quality of the transport services provided. Since the availability of rides depends on the behavior of carriers or. drivers, LimeJet does not guarantee that the passenger will always have offers for the provision of transport services.
6.2 The customer's right to a refund does not apply to orders within the LimeJet application. A request for a refund for transport services does not mean withdrawal from the contract on the basis of which the provision of the transport service was ordered.
6.3 The LimeJet application is provided as is. LimeJet does not guarantee that access to the LimeJet application will be uninterrupted or error-free. In case of any errors in the software, we will try to fix them as soon as possible, but we emphasize that the operation of the application may be limited due to occasional technical errors and we are not able to guarantee that the application will always be available (public crisis situation may result in service interruption).
6.4 LimeJet, its agents, directors and employees are not liable for any loss or damage you may suffer as a result of using the LimeJet application or in connection with the reliance on the ride you have ordered through the LimeJet application, including, inter alia: any direct or indirect damage to property or monetary loss, loss of profit, loss of business, contracts, contacts, goodwill, reputation and any loss that may arise from business interruption, loss or inaccuracy of data and any other type of loss or damage.
6.5 LimeJet's financial liability for breach of contract is limited to EUR 100. You will only be entitled to damages if LimeJet has intentionally breached the contract. LimeJet is not responsible for the actions or inactions of the carrier or. driver and is not liable for damages that the carrier or. the driver causes the passengers.
6.6 You agree to indemnify and hold harmless LimeJet, its affiliates, agents, employees and directors from any claims or losses (including liabilities, damages, costs and expenses of any nature) incurred as a result of your use of LimeJet (including rides that you ordered through the LimeJet application).
6.7 LimeJet may immediately terminate your use of the LimeJet application if you violate the Dispatch Operator's Transport Regulations, these General Terms and Conditions for Passengers or if we deem it necessary to protect the integrity of LimeJet or the safety of carriers and / or drivers.
** 7. Best practices for using LimeJet **
7.1 As LimeJet is not a transport service provider, any problems relating to the quality of transport services will be resolved in accordance with the rules and regulations of the transport service provider or the competent public authority.
7.2 We ask you to fill in the feedback form in the LimeJet application. This allows us to offer carriers and drivers suggestions for improving the quality of their services.
7.3 We expect you to use the LimeJet application in good faith and to respect the carriers and drivers who offer their services through the LimeJet application. LimeJet reserves the right to cancel your account if you have violated the conditions set out in the Dispatch Operator's Conditions of Carriage, these General Terms and Conditions for Passengers or if your activities are harmful, ie withholding payment for the provision of transport services, fraud, disrespect to carriers and / or drivers. . In these cases, your LimeJet account may be terminated without notice.
7.4 LimeJet will use its best endeavors to ensure that the LimeJet application is used only by carriers and drivers who are of good repute and respect their profession and passengers. However, in no case can we guarantee that every transport service provider located in the LimeJet application will always meet the above criteria. If you come across a non-compliant transport service provider, please inform the company responsible for the service, the supervisory authority or our customer support.
** 8. Changes to the General Terms and Conditions **
8.1 If there are significant changes to the Transport Rules of the Dispatch Operator, the General Terms and Conditions for Passengers, you will be notified by e-mail or notification of the LimeJet application. If you continue to use the LimeJet application, this will be considered as acceptance of the amendments.
** 9. Final provisions **
9.1 Transport Rules of the Dispatching Operator, The General Terms and Conditions for Passengers shall, to the extent not excluded by law, be governed by and interpreted in accordance with the laws of the Slovak Republic. If the relevant dispute arising from the Dispatch Operator's Transport Regulations, the General Terms and Conditions for Passengers or the Contract could not be resolved through negotiations, the dispute shall be resolved in the competent court in the Slovak Republic.
