General Terms And Conditions For Drivers
These General Terms and Conditions for Carriers and Drivers set out the business conditions that apply to and regulate the use of LimeJet's services. LimeJet platforms, you must agree to LimeJet's terms and conditions.
1.1. LimeJet Company (also referred to as "we", "our" or "us") - QVOTA sr o, limited liability company, VAT ID: SK2023651465, ID: 46910590, registered office: ul. Svornosti 50 821 06 Bratislava - Podunajské Biskupice, (hereinafter also referred to as "LimeJet") LimeJet, but at the same time the companies and partners of the LimeJet Group are also referred to as such. The LimeJet Group refers to companies in which LimeJet exercises control (for example, LimeJet subsidiaries).
1.2. LimeJet Services - services provided by LimeJet, including the provision of transport services, the provision and maintenance of LimeJet applications, the LimeJet platform, In-app Payment, customer support, carrier-driver communication and other similar services.
1.3. LimeJet application - an application for smartphones for carriers, drivers and passengers on request and the use of transport services.
1.4. LimeJet's platform - a platform, a technology that connects passengers with carriers and drivers, helping them to move more efficiently within cities.
1.5. Passenger - a person requesting transport services using the LimeJet platform.
1.6. Carrier (also referred to as "you") - a taxi operator authorized under a concession to provide transport services and which uses LimeJet's intermediation activities to conclude passenger contracts, using the LimeJet platform.
1.6.1. Driver - the driver of the taxi vehicle as a carrier or an employee of the carrier. Each driver will be assigned a personal LimeJet Driver Account to use the LimeJet application and the LimeJet platform.
1.7. Contract - A contract between a carrier, a driver and LimeJet for the use of LimeJet's services, consisting of:
1.7.1. Transport regulations of the dispatching operator
1.7.2.General contract conditions for hauliers and drivers,
1.7.3. special expressions displayed in the LimeJet application, e.g. those relating to price information or service descriptions,
1.7.4. guidelines for carriers and drivers, and
1.7.5. other terms and conditions set forth in this Agreement, which may be amended from time to time, and
other general terms and conditions or documents mentioned in this document or concluded in the future between the carrier, the driver and LimeJet.
1. Tariff (fare) - a fee which the passenger is obliged to pay to the carrier for the provision of transport services.
1.9. LimeJet Fee - a fee that a carrier is required to pay for the use of LimeJet's LimeJet platform.
1.10. In-app Payment - payment cards, carrier invoicing and other payment methods that passengers use through the LimeJet application to pay for transport services.
1.11. LimeJet Driver Account
1.12. Transport services - a transport service provided by the carrier to the passenger via the driver on the basis of acceptance of the passenger's request via the LimeJet App.
1.13. Entity entrusted with the execution of payments - QVOTA sr, ie the entity responsible for technical support services in the provision of payment services to facilitate payments and / or invoicing on behalf of LimeJet. The Paying Agent may also discuss any complaints and settle any disputes regarding payments made by LimeJet.
2. CONCLUSION OF THE CONTRACT
2.1 Before using the LimeJet service, you must register by providing the required information in the website registration application and uploading the necessary documentation in accordance with our requirements. Upon successful completion of the registration, a personal account will be created for you, which is accessible by entering your username and password. By clicking on the "Register" button located at the end of the registration application, you declare and warrant that:
a) in accordance with the applicable legal regulations, you have the right to enter into an agreement with us on the use of the LimeJet platform for the provision of a transport service,
b) you have carefully studied, fully understood and agree to be bound by the Dispatch Operator's Transport Regulations and these General Terms and Conditions for Carriers and Drivers, including all obligations arising in accordance with the provisions of the Contract and as set out herein,
c) all information you have provided to us is accurate, correct and complete, you will carefully maintain your LimeJet Driver Account and update your profile information at all times,
d) you will not authorize other persons to use your LimeJet Driver Account, nor will you transfer or assign the authorization to any other person,
e) you will not use the LimeJet Services for unauthorized or illegal purposes and will not disrupt the proper operation of the LimeJet Services,
f) you comply at all times with all laws and regulations in force in the country in which you provide transport services, including, but not limited to, the laws governing passenger transport services
g) you will not misuse any error, whether knowing or unknowing, which will make the LimeJet Driver Account unjustifiably made available to you.
2.2. During registration, you are required to provide the necessary bank information if you fill in your payment information. You must provide a bank account for the company. We transfer fees for the use of in-app payment to the bank account you specified. We are not responsible for any incorrectly executed monetary transactions if you have provided incorrect bank details.
2.3. After submitting your registration request, you will receive an email with additional conditions that you must meet in order to use the LimeJet service. These conditions may include the provision of a copy of the taxi driver's license, a copy of the taxi operator's license, a copy of the taxi driver's certificate, criminal record, valid driving license, satisfactory technical condition of the vehicle, training course, GPS-enabled mobile device and other conditions specified in the relevant e-mails. Failure to comply with these terms and conditions may result in termination of the Agreement and termination of the right to use LimeJet's services.
2.4. You agree that in certain cities or countries, LimeJet may assign any of its obligations under the Dispatch Operator's Conditions of Carriage, the General Terms and Conditions for Carriers and Drivers or the Agreement to LimeJet Group companies and partners. This includes, but is not limited to, assigning rights and responsibilities for reviewing documents related to registration applications, training, collecting fees for LimeJet Fee services, transferring applicable fees, arranging payments through In-app Payment, licensing LimeJet App, etc. .
2.5. In fact, transport services can only be provided by a specific natural person listed in the registration process as a driver. Such a natural person may use the driver's account only if he / she has read the Transport Rules of the Dispatcher, these General Terms and Conditions for Carriers and Drivers and agrees to be bound by any other documentation that is part of this Agreement. Entities mentioned in your payment details and natural persons, which specifically provide transport services pursuant LIMEJET ACCOUNT ACCOUNT, jointly and severally liable for any breach of general terms and conditions for carriers and driver and contracts concluded by the carrier.
2.6. Registration of the LimeJet Driver Account as a carrier. After concluding a special contract, the carrier can individually register the accounts of its employees as a driver. In such a case, the carrier is required to ensure that its employees as drivers comply with the requirements of the Dispatch Operator's Conditions of Carriage, these General Contractual Conditions for Carriers and Drivers, the Contract and any other contracts and agree to act in accordance with its terms and conditions; obligations. The carrier and its servants as drivers shall remain jointly and severally liable for any infringement committed by such servant as driver, in particular if it is established that:
(a) the carrier is not entitled to offer and provide transport services as well as to conclude contracts for the carriage of passengers in accordance with point 4.1. Transport regulations of the dispatching operator;
(b) the carrier and / or driver has failed to fulfill an obligation under this clause of the General Conditions of Carriage for carriers and drivers;
(c) the carrier has breached its obligations as a taxi operator within the meaning of point 6.1. Transport regulations of the dispatching operator;
(d) the driver has failed to fulfill his obligations within the meaning of point 7.2. Transport regulations of the dispatching operator;
(e) the carrier and / or driver breaches the obligation to carry out transport by taxis in accordance with point 8.1. Transport Rules of the Dispatching Operator, or the said procedure by its own procedure, resp. omission of the procedure will allow any third party, even if it is a person without a LimeJet Driver Account and / or without a taxi driver's license, if this third party has provided transport services mediated through the LimeJet App thereby ultimately causing us to breach the obligation under point 5.1.2. Transport regulations of the dispatching operator;
f) the carrier and / or driver allows a third party without a LimeJet Driver Account and / or without a taxi driver's license to provide transport services mediated through the LimeJet App, ultimately causing us to breach the obligation in within the meaning of point 5.1.1. Transport regulations of the dispatching operator;
g) the carrier and / or the driver by any action resp. failure to act will cause us to breach our obligations under point 5.1. Transport regulations of the dispatching operator;
3. RIGHT TO USE LimeJet APP AND LimeJet DRIVER ACCOUNT
3.1. License to use the LimeJet APP and the LimeJet Driver Account. We hereby grant you a license to use the LimeJet APP and the LimeJet Driver Account. This license does not grant you the right to sublicense or sublicense any rights to third parties. Notwithstanding the foregoing, and if separately agreed, carriers may sublicense the LimeJet App and the LimeJet Driver Account to their employees as drivers.
3.2. While using the LimeJet App and / or the LimeJet Driver Account, you cannot:
a) decompile, reverse engineer, or otherwise attempt to obtain source code for the LimeJet App or LimeJet Driver Account or other LimeJet software;
b) modify the LimeJet App or LimeJet Driver Account in any way or form, or use modified versions of the LimeJet App or LimeJet Driver Account;
c) transfer files containing viruses, corrupted files or other programs that may damage or adversely affect operation on the LimeJet Platform;
d) attempt to gain unauthorized access to the LimeJet App, the LimeJet Driver Account, or other LimeJet Services.
3.3. This license granted in this document is automatically and concurrently terminated upon termination of the Agreement. Upon termination of the Agreement, you must immediately stop using the LimeJet App and the LimeJet Driver Account. We are also entitled to block and delete the driver account without prior notice.
3.4. Use of LimeJet labels and markings. In addition, we may give you marks, labels, stickers or other markings that relate to the LimeJet brand, or otherwise indicate that you use the LimeJet Platform. We provide you with a non-exclusive license, which may not be further sublicensed or transferred, to use such designations and only to indicate that you provide transportation services through the LimeJet Platform. Upon termination of the Agreement, you must immediately remove and discard all markings relating to the LimeJet trademark.
3.5. All copyrights and trademarks, including source code, databases, logos and visual designs, are the property of LimeJet and are protected by copyright, trademark and / or trade secret laws and the provisions of international treaties. By using the LimeJet platform or other LimeJet services, you do not acquire any proprietary rights to any intellectual property.
4. PROVISION OF TRANSPORT SERVICES
4.1. Obligations of the carrier and the driver. You hereby guarantee to provide transport services in accordance with the Dispatch Operator's Transport Regulations, the General Terms and Conditions for Carriers and Drivers, the Contract, as well as the laws and regulations in force in the country in which you provide transport services. Please note that you are fully responsible for any violation of any laws and regulations that may arise in the provision of transport services.
4.2. To provide transportation services, you must have all licenses (including concession, valid driver's license, taxi driver's license), permits, vehicle insurance, registration, certification, and other documents that apply in your jurisdiction. It is your responsibility to keep all the above documents valid. LimeJet reserves the right to require you to provide evidence and to submit for review all necessary licenses, permits, approvals, authorizations, registrations and certifications. In the event that LimeJet incurs any damage (ie in particular any penalties, non-pecuniary damage, lost profits, etc.) are imposed on LimeJet in connection with a breach of your legal or contractual obligations, you undertake to indemnify LimeJet for all such damage.
4.3. You must provide transport services in a professional manner in accordance with the business ethics applicable to the provision of such services and endeavor to meet the passenger's requirements in his best interests. Among other things, you i) you must choose the least freight route for the passenger, unless the passenger expressly requests otherwise, ii) you must not make any unauthorized stops, iii) you must not have any passengers in the vehicle other than the passenger and passengers accompanying him / her, and iv ) you must comply with all applicable traffic and regulations, ie you must not perform any activities that could interfere with driving or perception of traffic conditions, including holding the phone in your hand while the vehicle is in motion.
4.4. You have the exclusive right to determine when you provide transport services. You have the right to accept, reject or ignore requests for transport services from passengers of your choice.
4.5. Costs incurred in the provision of transport services. You are obliged to provide and maintain all the equipment and resources necessary to perform the transport services at your own expense, including a car, smartphone, etc. You are also responsible for all costs incurred during the performance of transport services, including, but not limited to, fuel, mobile data plan costs, service charges, vehicle depreciation, insurance, applicable corporate or payroll taxes, etc. . Using the LimeJet App can consume a lot of data in your mobile data program. Therefore, we recommend that you order a data program with unlimited or very high data usage capacity.
4.6. The amount of the fare. You are entitled to charge a fare in each case in which you have received a passenger through the LimeJet platform and provided the transport service as requested (ie fare). You will always have the right to charge the passenger a lower fare than the fare shown in the LimeJet App. However, charging a fare for a passenger lower than that specified in the LimeJet App does not reduce the LimeJet Fee service charge.
4.7. Pre-agreed fare amount. The amount of the fare is announced to the passenger in advance via the LimeJet App and subsequently accepted by the passenger via the LimeJet App, all before the journey begins,
4.8. LimeJet may also reduce or cancel the fare if
(a) has a reasonable cause proposed by the passenger, such as fraud or a complaint alleging an infringement by you, or
b) has a reasonable suspicion of fraudulent driving (eg so-called self-order). LimeJet will exercise its right to reduce or cancel the fare amount in a reasonable and justified manner.
4.9. The passenger is entitled to pay the amount of the fare for transport services via the In-app Payment application as specified in section 6 of these General Terms and Conditions for Carriers and Drivers. In the event that the passenger does not pay or refuses to pay, LimeJet will send the passenger a request for payment of the claim on your behalf. An authorization of this type is derived from the authorization of the paying agent granted to LimeJet and does not mean that LimeJet is not obliged to compensate the fares not paid by the passenger. If the passengers in the vehicle do not agree to the payment of the fare for the provision of the transport service, the fare will be paid by the passenger who ordered the provision of the transport service. If, in a justified case, the passenger refuses to pay the fare to the account,
4.10. Confirmation of driving. LimeJet will create and forward a travel certificate to the passenger after each successful provision of transport services, containing the following information: carrier's business name, place of business, driver's name and surname, driver's photograph, concession number, vehicle registration number (ECV), date, time , place of embarkation and disembarkation, duration and length, fare and the amount of the fare paid for the provision of transport services. The driving license is available via the LimeJet Driver Account.
4.11. Cancellation fee and waiting fee
The passenger can cancel the request for transport services, which the driver received via the LimeJet App. The driver is entitled to a cancellation fee for canceled transport services in the amount specified in the LimeJet App in the event that the passenger cancels the accepted request for transport services after a certain period specified in the LimeJet App. The driver is also entitled to a waiting fee, the so-called standing in the amount specified in the LimeJet App in the event that the passenger within a certain period specified in the LimeJet App from the arrival of the carrier or. the driver at the agreed place of collection of the passenger, does not arrive at the agreed place of collection of the passenger.
4.12. If, during the provision of transport services, the passenger or his passenger negligently damages the vehicle or its equipment (inter alia by damaging or soiling the vehicle or causing the smell of the vehicle), you have the right to ask the passenger to pay a fine of up to EUR 50 and claim compensation for any damage exceeding fines. If the passenger does not agree to the payment of the fine and / or compensation, you must inform us of this fact and we will try to collect the fine and / or the relevant costs from the passenger on your behalf. Please note, however, that we are not liable for any direct or indirect damage caused to passengers in connection with the cleaning or maintenance of the vehicle.
4.13. Your tax obligations. You acknowledge that you are required to comply fully with all tax obligations that may arise under applicable regulations in connection with the provision of transportation services, including (i) payment of income tax, tax on social security contributions or any other applicable tax, and (ii) compliance with all the obligations of employees and tax records for calculations in connection with accounting and transfers to the competent public authorities in accordance with the applicable legislation. If the tax office submits to us a valid request for information about your activity, we may provide the tax office with information about the activities you have performed to the extent provided by applicable law. In addition, it is your responsibility to comply with all applicable tax regulations, which may relate to the provision of transport services. You hereby agree to indemnify LimeJet for any government fees, claims, payments, fines or other tax obligations that LimeJet incurs in connection with your obligations under applicable tax laws that you have not complied with (including income tax payments). and taxes on social security contributions).
4.14. Authorization of the carrier to issue invoices. LimeJet has the right to issue an invoice to the passenger on your behalf in order to reimburse you for any travel, contractual penalties or other charges provided by LimeJet to you. The invoice will be made available to you in your LimeJet Driver Account.
5. LimeJet FEES
5.1. You are required to pay a fee (ie, a LimeJet fee (LimeJet Fee)) in order to use LimeJet's services. The LimeJet (LimeJet Fee) fee is paid based on the amount of the fare for each transport service you have provided. The amount of the LimeJet Fee is available via email, the LimeJet App, the LimeJet Driver Account, or other appropriate means. Please note that the amount of the LimeJet Fee may change from time to time. We will notify you in advance of any such change.
5.2. You must pay the LimeJet Fee and all other fees due for the previous month no later than the 15th of the following month. In the event of a delay in paying the LimeJet Fee, you are required to pay a penalty of 0.10% (zero in full, four hundred percent) of the outstanding amount for each day of delay. You are required to reimburse all costs incurred by us in connection with debt collection activities.
6. PAYMENT THROUGH IN-APP PAYMENT
6.1. We can allow passengers to pay for the transport service via payment cards, carrier invoicing and other payment methods directly in the LimeJet App (ie via the In-app Payment application). You hereby authorize us to act on your behalf as your limited sales representative solely for the purpose of collecting the amount of travel or other charges paid to passengers by payment in the In-app Payment application. Any payment obligation made by the passenger via the In-app Payment application shall be deemed to have been fulfilled at the time the payment was made.
6.2. If the passenger wants to pay via the In-app Payment application, you may not refuse or influence the passenger to oppose the use of the payment system via the In-app Payment application. In the event that you refuse to accept payment via the In-app Payment without a valid reason, we are entitled to charge you a contractual penalty of EUR 15 for each refusal and / or to revoke your right to use LimeJet's services in the event of repeated behavior. .
6.3. LimeJet reserves the right to distribute the promo code to passengers at its discretion based on individual promotion. If the use of promo codes is suspected to be fraudulent, illegal, used by passengers in violation of the Dispatch Operator's Conditions of Carriage, our General Conditions of Carriage for Drivers and Drivers, then the promo code may be revoked and LimeJet will not provide financial compensation. to the driver for this excess amount.
6.4. You have the right to review payment reports in the In-app Payment application in your LimeJet Driver Account. The reports will show the amounts of In-app Payment payments that were made in the previous week, as well as the amounts of LimeJet Fee withheld. You must notify us of any important circumstances that may affect our obligation to collect and distribute the fare amounts paid through the In-app Payment application.
6.5. We are not required to reimburse you for the amount of the fare due that the passenger will pay if the payment in the In-app Payment failed because the credit card or other payment of the passenger was canceled or was unsuccessful for other reasons. In this case, we will help you request the amount of the fare due from the passenger and forward it to you as soon as the passenger makes the required payment.
6.6. Before providing transport services, you must verify that the service is actually provided to the correct passenger or that the passenger has explicitly confirmed that it allows other passengers to travel under the passenger's account. If you make a mistake in identifying a passenger who has made a payment via the In-app Payment application, the person who has not been provided with or approved transport services for other passengers will be provided with financial compensation for the amount of the fare. In this case, you are not entitled to receive travel expenses from us. In addition, we are entitled to charge you a contractual penalty of up to EUR 10 for any unauthorized payment made in the In-app Payment application.
6.7. Please note that we will offset all travel expenses paid through In-app Payment against the amounts you are required to pay us (ie LimeJet (LimeJet Fee) fees and contractual penalties)). We reserve the right to meet any of your financial obligations to LimeJet Group companies. In this case, we will acquire the right to claim from you. We may set off any of your financial obligations against any financial obligations you may have towards us.
6.8. If we are unable to pay you fees because you do not enter your bank account details in your driver account, or if these bank account details have been incorrectly recorded, we will withhold these payments for 180 days. If you do not provide us with the correct bank account details within 180 days of the date on which the right to make such payments was established, your right to payment of unpaid fares will lapse.
7. CUSTOMER SUPPORT
We provide customer support to carriers and drivers regarding the use of LimeJet services. We have the right to suspend customer support services if you are more than 5 (five) calendar days late in any of your payments.
8. EVALUATION AND ACTIVITY
8.1. In order to guarantee the provision of high quality services and to provide passengers with an additional guarantee, you hereby confirm that passengers can evaluate you and leave feedback on the quality of the transport services you have provided. Your average rating will be linked to your driver account and will be available to passengers in the LimeJet app. If we find that a rating or comment isn't listed in good faith, it may not be reflected in your rating calculations.
8.2. In addition to evaluation, we also measure your level of activity and provide you with score information based on your activity regarding acceptance, rejection, non-response and fulfillment of a transport service request.
8.3. In order to provide passengers with reliable services, we can set minimum average ratings and minimum activity scores that drivers must create and maintain. If you do not increase your average rating or activity score to the minimum level within the set time limit after the relevant notification from us, your driver account will be automatically suspended temporarily or permanently. Due to any external circumstances, we may, in justified cases, cancel the suspension of your account or if it is found that the suspension was caused by a system error or incorrect ratings.
9. MARKET AND CAMPAIGN OVERVIEW
9.1. Market reports. We can send you market reports via the LimeJet App, LimeJet Driver Account, SMS, email or other means to increase your awareness of when passenger demand is highest. Such market reports are strongly recommendable and do not impose any obligations on you. As the estimates of the market reports are based on previous statistics, we can in no way guarantee that the current market situation will correspond to the estimates given in the market report.
9.2. Campaigns promising a minimum income. If you provide transportation services within a specified time frame, we may run campaigns to guarantee a minimum income. If you do not reach the set minimum, we will compensate for this gap. Specific terms and conditions will be sent via the LimeJet App, via the LimeJet Driver Account, SMS, email or other means. It is up to us to decide whether, when and to which drivers we will provide such campaigns. If we have a reasonable suspicion of any fraudulent activity you perform, we may withhold your fare until the suspicion of fraud is clarified.
9.3. Campaigns for passengers. In order to promote the LimeJet platform, we may also occasionally organize various campaigns for passengers. If the amount of the fare to be paid by passengers is reduced as part of this campaign, we will pay you compensation equal to the monetary value of the benefit offered to the passenger. We may include marketing compensation against LimeJet's (LimeJet Fee) fee.
10. RELATIONSHIP BETWEEN YOU, US AND PASSENGERS
10.1. You hereby acknowledge and agree that we provide brokerage services and do not provide transportation services. Through the LimeJet platform and LimeJet services, we act as a market that connects passengers with drivers, helping them to move more efficiently within cities. You acknowledge that you provide transportation services under a passenger contract and that you provide them alone or through your employees as drivers as an economic and professional activity.
10.2. You acknowledge that no employment contract or employment relationship is or will be established between you and us. You also acknowledge that there is no joint venture or partnership between you and us. You may not act as our employee, agent or representative or undertake any contract on our behalf. If, as a result of the implied application of binding law or otherwise, you consider yourself our employee, you agree to waive any claims against us that may arise as a result of such an implied (indirect) employment relationship.
10.3. You may not transfer your rights and obligations arising from the Dispatch Operator's Transport Regulations, the General Terms and Conditions for Carriers and Drivers or the Contract to any third parties.
11. PERSONAL DATA PROCESSING

12.1. The LimeJet platform is provided on an "as is" and "as available" basis. We do not represent, warrant or guarantee that access to the LimeJet platform will not be interrupted or incorrect. As the use of the LimeJet platform to request transportation services depends on the behavior of passengers, we do not guarantee that your use of the LimeJet platform will result in any request for a transportation service.
12.2. To the maximum extent permitted by applicable law, we and LimeJet representatives, directors and employees are not liable for any loss or damage you may suffer as a result of using LimeJet's services, including, but not limited to:
a) any direct or indirect damage to property or monetary losses, loss of profit or anticipated savings,
b) termination of business, contracts, loss of contacts, goodwill, reputation and any loss that may arise from the interruption of business activities, loss or inaccuracy of data, and
(c) any other type of loss or damage.
12.3. Financial liability on our part in connection with a breach of the Dispatch Operator's Transport Regulations, the General Terms and Conditions for Carriers and Drivers or the Contract will be limited to EUR 500. You will only be entitled to claim damages if we have intentionally violated the Dispatch Operator's Transport Regulations, the General Terms and Conditions for Carriers and Drivers or the Contract.
12.4. We are not liable for the acts or omissions of the passenger or passenger and we are not liable for any loss or damage incurred by you or your vehicle as a result of the acts or omissions of the passenger or passengers.
12.5. You will be fully responsible for any breach of the Dispatch Operator's Conditions of Carriage, the General Terms and Conditions for Carriers and Drivers, the Contract or any other applicable laws or regulations, and you must immediately stop and correct such breach as soon as we accept the relevant request from us or any state. authority. You are obliged to indemnify us for any direct and / or indirect loss and / or damage, loss of profit, costs, penalties or fines that may occur in connection with a breach of the Dispatch Operator's Transport Regulations, these General Terms and Conditions for Carriers and Drivers, Contracts and laws and regulations. If the passenger asserts any claims against us in connection with the provision of transport services, you must compensate us for this damage in full within 7 (seven) days of receipt of the relevant request by us. In the event that we claim against you a contractual penalty for violation of the Dispatch Operator's Transport Regulations, General Terms and Conditions for Carriers and Drivers, the Contract or any other applicable laws or regulations, this does not affect our right to damages. In the event that we are entitled to submit a claim against you to the compensation body, you are obliged to reimburse us for any legal representation costs related to the assessment of the damage and the submission of claims related to the compensation. 13. DURATION AND TERMINATION
13.1. The conditions explicitly stated in the Transport Rules of the Dispatching Operator and these General Contractual Conditions for Carriers and Drivers shall enter into force and effect on the day of submission of the application for registration. The Agreements and other terms and conditions will become effective upon the availability of a specific document or message to you and you can begin or continue to provide transportation services on the LimeJet platform.
13.2. You may terminate this Agreement at any time by giving at least 7 (seven) days notice to LimeJet, upon which your right to use the LimeJet Platform and LimeJet Services terminates. LimeJet may terminate the Agreement at any time and for any reason in its sole discretion by giving you at least 3 (three) days' notice.
13.3. LimeJet reserves the right to immediately terminate the Agreement and block your access to the LimeJet Platform without prior notice in the event of a breach of the Dispatch Operator's Conditions of Carriage, these General Terms and Conditions for Carriers and Drivers or the Agreement, any applicable laws or regulations, or in our opinion. LimeJet, or cause damage to LimeJet's name, reputation or business. At our sole discretion, we may prohibit you from registering in the above cases by creating a new driver account.
13.4. If we suspect a breach of contract or fraudulent activity on your behalf, we may also immediately block your access to the LimeJet platform and the LimeJet Driver Account during the investigation period. If the investigation refutes such suspicions, the access block will be lifted.
13.5. Our goal is to provide the highest quality services to all passengers, so we monitor the driver's activity using the LimeJet platform. If you do not meet the minimum service requirements, such as the minimum rating and activity score, we are entitled to terminate the Agreement immediately without prior notice.
14.1. Any changes to the Dispatch Operator's Transport Regulations and these General Terms and Conditions for Carriers and Drivers will take effect after we make them available to you via e-mail, the LimeJet App or the LimeJet Driver Account and you continue to provide transport services. .
14.2. We will give you at least 14 (fourteen) days' notice of a change in the Dispatch Operator's Transport Regulations and these General Terms and Conditions for Carriers and Drivers and will publish a revised version on the website (limejet.com/legal-sk). If you continue to use LimeJet's services, we will assume that you have accepted the revised terms.
15. APPLICABLE LAW AND COMPETENT JURISDICTION
15.1. The Transport Regulations of the Dispatching Operator and the General Contractual Conditions for Carriers and Drivers, and the Contract to the extent that this is not excluded by legal regulations, are governed, interpreted and enforced in accordance with the legal order of the Slovak Republic. If the relevant dispute arising from the Dispatch Operator's Transport Regulations, the General Terms and Conditions for Carriers and Drivers, or the Contract could not be resolved through negotiations, then it shall be resolved in the competent court in the Slovak Republic.
16.1. You are required to notify us immediately of any changes to your contact information.
16.2. Any notice that must be provided on the basis of the Dispatch Operator's Transport Regulations, these General Terms and Conditions for Carriers and Drivers and the Contract will be provided sufficiently if i) it is delivered in person, ii) it is sent by courier with confirmation of delivery, iii) will be sent by registered mail, iv) will be sent by e-mail, or v) will be made available through the LimeJet App or the LimeJet Driver Account. Any notice sent or sent in accordance with this provision shall be deemed to have been received if: i) it was delivered in person to the other party at the time of delivery, ii) in the case of delivery by courier, it is the courier date ) in the case of sending by registered letter it is 10.
17. FINAL PROVISIONS
If any provision of these General Terms and Conditions for Carriers and Drivers is deemed unenforceable, the Contracting Parties shall replace the provision to which it relates with an enforceable provision which approximates the purpose and economic effect of that provision. Date of entry into force of these General Terms and Conditions for Carriers and Drivers: 01.09.2021.
